5. PLACING AN ORDER

We will not cancel orders for discriminatory or otherwise unlawful reasons.

Where an order has been paid for but is not accepted, amounts due to be returned will be refunded.

If there is a significant delay, your rights may include requiring delivery within an additional appropriate period or cancelling the contract where permitted by law.

Nothing in these Terms limits your statutory rights relating to late delivery.


16. RISK IN THE GOODS

For consumer purchases, risk in the goods passes to you when you, or a person identified by you to take possession of the goods, receives them, subject to applicable law.

Different rules may apply if you independently arrange for a carrier that was not offered by us.


17. OWNERSHIP OF GOODS

Ownership of goods will pass to you in accordance with applicable law and the terms of the transaction, generally once full payment has been received and the goods have been supplied.

18. RIGHT TO CANCEL ONLINE ORDERS

19. KELLYNGSTON 30-DAY RETURN POLICY

In addition to statutory consumer rights, Kellyngston provides eligible customers with a 30-day return period, subject to the conditions set out in our Return & Refund Policy.

This voluntary policy is additional to, and does not replace, your legal rights.

20. FAULTY, DAMAGED OR MISDESCRIBED GOODS

UK consumer law provides legal remedies where goods do not conform to the contract.

Nothing in this clause excludes liability for fraud or prevents a consumer from relying on statements or rights that cannot legally be excluded.


43. CONSUMER PROTECTION

  • Consumer Rights Act 2015;

  • Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013;

  • Digital Markets, Competition and Consumers Act 2024;

Nothing in these Terms is intended to waive, exclude or restrict a mandatory statutory right.

If a provision conflicts with a mandatory legal right, the mandatory legal right will prevail.


44. GOVERNING LAW AND COURTS

If you are a consumer resident in the United Kingdom, these Terms and any contract between you and Kellyngston will be governed by the applicable law of the part of the United Kingdom in which you live, to the extent required by law.

Consumers resident in:

  • England or Wales may generally bring proceedings in the courts of England and Wales;

  • Scotland may generally bring proceedings in the Scottish courts; and

  • Northern Ireland may generally bring proceedings in the courts of Northern Ireland,

subject to applicable consumer jurisdiction rules.

Nothing in these Terms deprives you of mandatory protections provided by the law applicable to you.
